1. Agreement to Terms

By accessing or using the SCapitalFX mobile trading application and related services (“Platform”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, you may not use the Platform.

2. Eligibility

To use SCapitalFX, you must:

  • Be at least 18 years of age
  • Have the legal capacity to enter into a binding agreement
  • Not be a resident of a jurisdiction where trading in leveraged financial products is prohibited
  • Provide accurate and complete registration information
  • Complete identity verification (KYC) as required

3. Account Registration

You must register for an account to use our trading services. You are responsible for maintaining the confidentiality of your account credentials, including your password, PIN, and two-factor authentication details. You are responsible for all activities that occur under your account.

You must notify us immediately of any unauthorized access to your account by contacting support@scapitalfx.com.

4. Trading Services

SCapitalFX provides an online trading platform for the following financial instruments:

  • Foreign exchange (Forex) currency pairs
  • Precious metals (Gold, Silver)
  • Global stock indices (CFDs)
  • Energy commodities (Oil, Natural Gas)
  • Cryptocurrencies (Bitcoin, Ethereum)

All trading is conducted as Contracts for Difference (CFDs). You do not own the underlying asset when trading on our platform. All trades are executed at market prices and are subject to available liquidity.

5. Account Types

We offer two account types:

  • Standard Account: Minimum deposit $10, zero commission, spreads from 1.2 pips
  • Raw Account: Minimum deposit $50, commission of $3.50 per lot, spreads from 0.0 pips

Leverage up to 1:200 is available on forex instruments. Maximum leverage varies by asset class and may be adjusted at our discretion.

6. Deposits and Withdrawals

Deposits and withdrawals are processed exclusively via cryptocurrency through our payment partner NowPayments. We accept over 50 cryptocurrencies including Bitcoin, Ethereum, and USDT.

  • Deposits are credited upon network confirmation
  • Minimum deposit: $10 (Standard), $50 (Raw)
  • Withdrawals are processed to your external cryptocurrency wallet
  • We reserve the right to request additional verification before processing withdrawals
  • Withdrawal processing time is typically within 24 hours

7. Leverage and Margin

Trading with leverage allows you to control a larger position with a smaller deposit. While leverage can amplify profits, it can also amplify losses. You may lose more than your initial deposit.

If your account equity falls below the required margin level, we may issue a margin call or automatically close your positions (stop-out) to protect your account from further losses. The stop-out level is set at 50% of required margin.

8. Fees and Charges

  • Spreads: Variable, depending on market conditions and account type
  • Commissions: $3.50 per lot on Raw accounts only; Standard accounts have zero commission
  • Overnight Swaps: Applied to positions held open past the daily rollover time
  • Deposit/Withdrawal Fees: No fees charged by SCapitalFX; network fees for cryptocurrency transactions apply

9. Risk Disclosure

Trading leveraged financial instruments involves significant risk. You should not trade with money you cannot afford to lose. Please read our full Risk Disclosure document before trading.

10. Prohibited Activities

You agree not to:

  • Use the Platform for money laundering or terrorist financing
  • Manipulate prices or engage in market abuse
  • Use automated trading systems designed to exploit system latency
  • Open multiple accounts without authorization
  • Provide false or misleading information during registration
  • Reverse engineer, decompile, or disassemble the Platform
  • Use the Platform in any way that violates applicable laws

11. Intellectual Property

The SCapitalFX platform, including its design, functionality, charting tools, and all associated content, is the intellectual property of SCapitalFX. You may not copy, modify, distribute, or create derivative works from any part of the Platform without our written consent.

12. Limitation of Liability

SCapitalFX shall not be liable for any losses arising from:

  • Market movements and trading losses
  • Technical failures, system outages, or internet connectivity issues
  • Delays in order execution due to market conditions
  • Unauthorized access to your account due to your failure to protect credentials
  • Force majeure events

Our total liability to you shall not exceed the amount of funds deposited in your account.

13. Account Suspension and Termination

We reserve the right to suspend or terminate your account at any time if:

  • You breach these Terms
  • We suspect fraudulent or illegal activity
  • You fail to complete required identity verification
  • Regulatory requirements compel us to do so

Upon termination, any remaining funds in your account will be returned to you, subject to applicable fees and regulatory requirements.

14. Dispute Resolution

If you have a complaint about our services, please contact us at support@scapitalfx.com. We will endeavour to resolve your complaint within 14 business days. If you are not satisfied with our response, you may follow our formal Complaints Procedure.

15. Amendments

We may amend these Terms at any time by posting updated terms on our website. Material changes will be communicated via email or in-app notification. Your continued use of the Platform after amendments constitutes acceptance of the updated Terms.

16. Governing Law

These Terms shall be governed by and construed in accordance with applicable international commercial law. Any disputes shall be resolved through arbitration in accordance with internationally recognized arbitration rules.
